My ex received a check from his employer that he is trying to classify as a gift. What is the difference between a gift and a marital asset or bonus?

Colorado is an equitable division state meaning the courts will divide property between the parties in an equitable fashion. A bonus from work is usually not a gift and should be classified as marital property. If you have not done so already, you should consult with an attorney on the matter.

Nothing in this communication should be considered legal advice. Nor should this communication lead you to believe that an attorney-client relationship has been created. Only after thorough analysis of your case with you in my office can I provide effective legal advice on your specific issue.
