We filed bankruptcy 2 years ago and reaffirmed our mortgage however our mortgage company says it was discharged during bankruptcy and that's how it is listed on my credit report. They say there is nothing they can do about it. In the mean time the $40,000 in payments don't show on my credit. Please help.

There are two things you need to do in this situation. First, contact your bankruptcy attorney and confirm that your reaffirmation agreement was properly executed and filed with the court. I am going to go on the assumption that it was properly executed and filed. You may be looking into filing an adversary proceeding or have a claim against the mortgage company under consumer protection laws. I am not a consumer protection attorney but I highly advise you to speak with one as soon as you possibly can.

The choice of a lawyer is an important decision and should not be based solely upon advertisements. Further, any statement on this website of prior results does not guarantee a similar outcome and should not be construed as legal advice, since an attorney-client relationship has not been created. Please do not send us confidential information unless an attorney-client relationship has been established, since you will not create an attorney-client relationship by doing so.
