I bought a brand new home in 2010. We had an inspector come a year later to check everything out, and he found water damage in the roof. This was supposed to be covered by our first-year home buyer warranty. We asked for this to be fixed by the builder, which they said they would. Now they're being foreclosed, and I'm not sure what my options are.

I'm not sure what you mean by the building is "being foreclosed" - do you mean in bankruptcy? If the builder goes out of business you may be out of luck unless he had a warranty company (basically insurance to handle warranty claims). Hard to say more based on what you posted.
