My wife has called the police on the 23rd of April when we were arguing and told them that I was trying to kill her. Police arrested me and I have spent 72 hours in jail. Once 72 hours were up I went back to jail due to an immigration overstay. While still in jail on Friday the 27th I was called for a court hearing, but was brought back the same morning due to an Immigration Hold. I got out on a $5000 Immigration and a $3000 (possibly criminal) bail on on the 27th of April at 6pm. On the 18th of May I have received a DV-109 Court Order that is due on the 24th of April, which was requested on the 27th of April by my wife. On the 18th of May I also found out that I have a warrant for my arrest due to the fact that I did not appear in court on the 27th of April. My question is is it safe (meaning would I be able to avoid arrest) for me to go to the court on Monday the 21st of May and ask for a cancellation of the arrest warrant and to set a different court date as I was never served with the criminal charges.

YOU NEED TO HIRE AN ATTORNEY NOW AND HAVE HIM REPRESENT YOU IN THIS MATTER. IF YOU CANNOT AFFORD ONE YOU NEED TO WALK IN TO COURT, GET A PUBLIC DEFENDER APPOINTED AND SEE IF THEY CAN GET THE WARRANT RECALLED AND QUASHED.
